Abstract: In the marine context, along with prohibiting certain forms of fisheries subsidies that contribute to overcapacity and overfishing, and eliminating subsidies that add to illegal, unreported and unregulated (IUU) fishing—actions high on the agenda of the United Nations (e.g. UNGA Resolution 68/71, SDG target14.6) and World Trade Organization (Ministerial Conference 11 Decision of 13 December 2017 on fisheries subsidies)— it is important to implement international legal instruments to improve fisheries management, both in small- and large-scale fisheries. This will help reduce fishing effort arising from IUU fishing, overcapacity, inadequate flag State control and enforcement, and poor regulatory measures towards long term conservation and management of fish stocks in the EEZ and the high seas
