The recent and last amendment to Coastal Regulation Zone (CRZ) Notification, 2011 has been notified on 22nd March, 2016 to extend validity of approved Coastal Zone Management Plans (CZMPs) of the coastal States and Union Territories (UTs) up to 31st January, 2017 or till such time the fresh CZMPs are approved by this Ministry, whichever is earlier. State Governments of Andhra Pradesh, Goa, Gujarat, Karnataka, Kerala, Maharashtra, Odisha Tamil Nadu, and West Bengal, and UT Administrations of Andaman & Nicobar Islands, Daman & Diu, Lakshadweep and Puducherry have asked for amendments in the CRZ Notification, 2011. The details of the issues raised and their grounds are at Annexure. (d): The Government of Goa has sought following amendments in the Notification.- (i) Removal of provision that prohibits putting up temporary and seasonal structures between the months of June to August. (ii) Regularization of dwelling units of traditional coastal communities including fisher-folk, which have been constructed in violation of the CRZ Notifications. (e): The Ministry has issued draft amendment notification inviting comments from the public on the proposal to permit temporary structures during June to August in non-operational mode. The issue of regularisation of dwelling units has been referred to Dr. Shailesh Nayak Committee constituted to examine the suggestions of the State Governments for amending CRZ Notification, 2011. The Committee has submitted the report. Details of the important issues raised by the Coastal States and Union Territories and their Grounds Maharashtra: The State Government has requested to examine the issue of loss of developable land area in Navi Mumbai due to demarcation of the High Tide Line (HTL) based on CRZ Notification 2011, and amend provisions in notification for slum rehabilitation, redevelopment of dilapidated, cessed and unsafe buildings in Greater Mumbai and classification of Koliwadas/Goathans as CRZ-III and to permit land reclamation for construction of coastal roads in the interest of people of Mumbai. Karnataka: State Government has requested to amend the Notification to: (i) permit construction of new dwelling within 100 meters from HTL ; (ii) permit certain constructions of temporary nature on the seaward side of such road when the roads fall in No Development Zone (NDZ) for temporary tourism related activities and the tourism development on the landward side of the road subject to environmental conditions; and (iii)incorporate special provisions as provided for the states of Kerala, Maharashtra and Goa to address issues faced by local agencies in tourism development. Kerala : The State Government has requested to amend the notification to.- (i) permit construction of houses/toilet/stores in NDZ of CRZ-III by Fishermen/traditional communities; (ii) reduce NDZ of CRZ-III along the banks of inland water bodies from 100 m to 50 m and 50 m to 10 meter in case of back waters; (iii) remove restriction regarding Floor Space Index and Floor Area Ratio for reconstruction of Dwelling Units in NDZ including the height of the building for slum development projects; and (iv) permit residential construction on landward of existing authorized structures and approved roads within 50 m of backwater. Examine inclusion of Vembanad as a Critically Vulnerable Coastal Area in the Notification as the Vembanad as Ashtamudi and Vembanad Backwaters are Ramasar sites and attracts wetland (Conservation and Management) Rules 2010 General issues raised by other coastal States and UTs (i) CRZ boundary along tidal influenced water bodies based on salinity ingress in several cases is not practical and this provision should be reviewed. (ii) No height restriction for cyclone shelters in the NDZ of CRZ-III. (iii) Fishery-related facilities to be permitted in NDZ including certain temporary constructions in the sand dunes. (iv) Allocation of abandoned salt pans for fishery related activities where there is acute shortage of land. (v) Permit expansion/ modernisation of fish-processing units including warehousing (vi) Permit small scale non-polluting livelihood/cottage industrial activities in CRZ area. (vii) CRZ clearance for foreshore facilities for fishing and fishery allied activities such as traditional fish-processing yards, boat building or repair yards, net mending yards, ice plants, ice storage, auction hall and jetties by Grama Panchayat.
